If you receive a notice cancelling your agency, I recommend advising the vendors of their on-going obligations if you have introduced anyone who might end up purchasing the property.

 

There is no obligation to do this and there is no obligation to provide names.  Your right to a commission if your party does purchase is entrenched in your Agency Agreement (or certainly should be!).

 

Here are two suggested drafts for letters that you might use, the first is where you are not providing names of your buyers, the second where you are providing names.

 

Please note the addendum to the second.   It is important to include this warning to protect you from any privacy issues.

 

Option 1;  No Names Provided

Dear Vendor (etc)

We acknowledge receipt of your notice cancelling our agency for the sale of your home, in accordance with that appointment the cancellation will take effect at midnight, seven days from receipt of the notice.

We have introduced a number of people to your home some of whom might still be interested in purchasing it. In the event that they, or any other potential buyers, could be further interested, we will notify your sole agent and work with them.

Meantime your new agent will have explained to you (as they are required to do in accordance with Real Estate Institute Rule 14.4) that if anyone introduced during our agency by us or our cooperating agencies purchases the property, you will still be liable for our fee. For your own protection therefore and in the event that anyone does approach you either privately or through another company, please call us before signing any agreement if you have any doubts or concerns.

We regret that we were unsuccessful during our agency but thank you for the opportunity you gave us to promote your home. We wish you every success with the new promotion.

Option 2: Some Names Provided
